Anti-Dipshit Avenger: "No Sue"
Posted: Wednesday December 7th, 2011 by

I dunno if Sony started this, but I know they added a "no sue" clause to their terms of service for the Playstation Network. Then EA jumped on board and now Microsoft has as well.

With the release of the new Xbox Live Dashboard Microsoft has tossed an update into their Terms of Use. You know, that wall of text you usually just "agree" to without reading? Well the update adds two clauses. Ones that says you're agreeing not to sue but submit to informal negotiations with binding arbitration to resolve disputes instead of going to court and letting a jury decide. The second clause is a class action waiver where you agree not to join any class action lawsuits filed against Microsoft. The problem here is that juries, despite their oath to do otherwise, tend to be sympathetic to consumers where as arbitration tends to favor corporations.

Now, Illinois has told companies that try to include these "no sue" clauses absolutely not. Now it's up to us to let our representatives know we're not interested either. The only way our States will go to bat for us is if we show them, with enough bodies, that they should see things our ways... otherwise we vote them out of office. "Will of the people" and all that.

Don't you roll your eyes at me. It still works when people overcome their apathy. I personally will NOT agree to the terms of use with those clauses in them. And I'm sending a letter to my representatives when I get done with this writeup.

You?

Update:
I logged in to cancel my Xbox Live subscription. In order to change my payment options and cancel, I have to accept their terms of use. And, I most certainly will not. I've contacted support to contact me when they've made the changes to my account and demanded a refund on my unused time since the new Terms were foisted upon me, not something I opted into.
I encourage you all to do the same.
